Social media platforms should be legally liable for user-generated content because they are no longer passive bulletin boards. They rank, recommend, suppress, boost, monetize, and target content with sophisticated algorithms designed to maximize engagement and advertising revenue. When a platform actively amplifies defamatory claims, dangerous misinformation, harassment, or incitement because it keeps users online, it is functioning much more like a publisher than a neutral carrier. Legal immunity has created a serious accountability gap. Victims of reputational ruin, coordinated abuse, or algorithmically amplified lies often have no meaningful remedy against the actor with the greatest power to prevent the harm. Meanwhile, platforms profit from scale while externalizing the social costs onto individuals, communities, elections, public health systems, and courts. In nearly every other industry, companies can be held responsible when their design choices foreseeably enable harm. A car company cannot escape responsibility for defective design by blaming drivers, and a pharmaceutical company cannot ignore foreseeable misuse while profiting from aggressive distribution. Digital platforms should not receive a special exemption simply because the harm is delivered through posts. Liability would not require treating every platform as guilty for every user statement. The law can distinguish between passive hosting and active algorithmic promotion, between reasonable moderation efforts and reckless indifference, between small forums and trillion-dollar companies that already have vast technical capacity. The goal is not to eliminate free expression, but to align incentives: if platforms profit from recommending content, they should also bear responsibility when their systems foreseeably spread unlawful and dangerous material. Without liability, platforms have every reason to prioritize engagement first and safety second. With liability, they would invest more seriously in moderation, transparent appeals, better detection of coordinated manipulation, and safer algorithmic design. Free speech is important, but it does not require giving powerful corporations blanket immunity for profitable amplification of harm. Accountability is not censorship; it is the basic condition for a healthier digital public sphere.

Holding platforms liable would shift accountability away from the true perpetrators, undermining the principle that individuals are responsible for their own actions and words. Liability protections have been instrumental in fostering the open internet, enabling diverse communities, citizen journalism, and the free exchange of ideas to flourish. Removing these protections would dismantle the very foundations of this vibrant digital ecosystem.
